Terms of Service — Ezras Nashim App

Welcome to Ezras Nashim. These Terms of Service ("Terms") govern your access to and use of the Ezras Nashim mobile application and related services (the "App"), operated by Ezras Nashim ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

The App is not directed at children under 13, and you must be at least 13 years old to use it. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent that you meet these requirements.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate information when creating an account and to keep it up to date.
• You may delete your account at any time from the Profile screen in the App. Upon deletion, your profile and login are permanently removed and records linked to your account are unlinked from it, continuing only as anonymous device history or as community content without your name, as described in our Privacy Policy.

3. Use of the App

The App provides spiritual and educational resources for Jewish women, including Torah content, prayers (Tefilla), charitable giving (Tzedaka), mitzvah tracking, community features, and calendar-based information such as Zmanim and Shabbat times. You agree to use the App only for lawful, personal, non-commercial purposes and in accordance with these Terms.

You agree not to:

• Use the App in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems.
• Interfere with, disrupt, or place undue load on the App or its infrastructure.
• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law.
• Use the App to harass, abuse, or harm others, or to post unlawful, offensive, or infringing content.

4. User-Submitted Content

Some features let you submit content, such as Tehillim chain intentions, dedication messages, prayer requests, and feedback. You retain ownership of content you submit, but you grant us a non-exclusive, royalty-free license to use, store, display, and share that content as necessary to operate the relevant features (for example, displaying a Tehillim chain to other participants).

You are solely responsible for the content you submit and confirm that you have the right to share it. We may remove content that violates these Terms or that we reasonably consider inappropriate, without prior notice.

5. Donations

• Donations made through the App are processed by our third-party payment processor, Stripe. By making a donation, you also agree to Stripe's applicable terms.
• Donations are voluntary. Unless required by law, donations are generally non-refundable. If you believe a donation was made in error, please contact us.
• We do not store your full payment card details; these are handled directly by Stripe.
• You are responsible for confirming the tax-deductibility of any donation in your own jurisdiction.

6. Intellectual Property

The App, including its design, text, graphics, logos, and original content, is owned by Ezras Nashim or its licensors and is protected by intellectual property laws. Torah content and other materials may be provided by contributors and remain the property of their respective owners. You may not copy, reproduce, distribute, or create derivative works from the App or its content without our prior written permission, except for your own personal, non-commercial use.

7. Third-Party Services

The App relies on third-party services, including Supabase, Stripe, OneSignal, and Hebcal. Your use of these features may be subject to those providers' terms and privacy policies. We are not responsible for the practices or availability of third-party services.

8. Religious and Informational Content

Content in the App, including prayer times (Zmanim), Shabbat times, halachic guidance, and Torah materials, is provided for informational and inspirational purposes only. While we strive for accuracy, times and content may vary based on location, calculation method, and custom (minhag). You should consult a qualified rabbinic authority for halachic decisions and verify time-sensitive information independently.

9. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any content is accurate or complete.

10. Limitation of Liability

To the maximum extent permitted by law, Ezras Nashim and its operators, contributors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of (or inability to use) the App.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms or if we discontinue the App. You may stop using the App and delete your account at any time. Provisions that by their nature should survive termination will continue to apply.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by other means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

ברוכה הבאה לעזרת נשים. תנאי שימוש אלה ("התנאים") מסדירים את הגישה והשימוש שלך באפליקציית עזרת נשים ובשירותים הנלווים (ה"אפליקציה"), המופעלים על ידי עזרת נשים ("אנחנו" או "שלנו"). בהורדה, בגישה או בשימוש באפליקציה את מסכימה להיות כפופה לתנאים אלה. אם אינך מסכימה, אנא אל תשתמשי באפליקציה.

1. זכאות

האפליקציה אינה מיועדת לילדים מתחת לגיל 13, ועלייך להיות בת 13 לפחות כדי להשתמש בה. אם את בין גיל 13 לגיל הבגרות במקום מגורייך, את מאשרת שהורה או אפוטרופוס עיין בתנאים אלה והסכים להם בשמך. בשימוש באפליקציה את מצהירה שאת עומדת בדרישות אלה.

2. החשבון שלך

• את מתחייבת למסור מידע מדויק בעת יצירת החשבון ולעדכנו בהמשך.
• באפשרותך למחוק את חשבונך בכל עת ממסך הפרופיל באפליקציה. עם המחיקה, הפרופיל ופרטי הכניסה שלך נמחקים לצמיתות, ורשומות שהיו מקושרות לחשבון מנותקות ממנו וממשיכות רק כהיסטוריה אנונימית של המכשיר או כתוכן קהילתי בלי שמך, כמפורט במדיניות הפרטיות שלנו.

3. השימוש באפליקציה

האפליקציה מספקת משאבים רוחניים וחינוכיים לנשים יהודיות, ובהם תוכן תורני, תפילות, נתינת צדקה, מעקב מצוות, תכונות קהילתיות ומידע מבוסס לוח שנה כגון זמני היום וזמני שבת. את מתחייבת להשתמש באפליקציה למטרות חוקיות, אישיות ולא מסחריות בלבד, ובהתאם לתנאים אלה.

את מתחייבת שלא:

• להשתמש באפליקציה בדרך המפרה חוקים או תקנות.
• לנסות להשיג גישה לא מורשית לאפליקציה, לחשבונות של משתמשות אחרות או למערכות שלנו.
• להפריע לאפליקציה או לתשתית שלה, לשבש אותן או להעמיס עליהן יתר על המידה.
• לבצע הנדסה לאחור, לפרק או לנסות לחלץ את קוד המקור של האפליקציה, אלא במידה המותרת בחוק.
• להשתמש באפליקציה כדי להטריד, להתעלל או לפגוע באחרים, או לפרסם תוכן בלתי חוקי, פוגעני או מפר זכויות.

4. תוכן שנמסר על ידי משתמשות

תכונות מסוימות מאפשרות לך למסור תוכן, כגון כוונות לשרשראות תהילים, הקדשות, בקשות תפילה ומשוב. הבעלות על התוכן שמסרת נשארת שלך, אך את מעניקה לנו רישיון לא בלעדי וללא תמלוגים להשתמש בתוכן, לשמור אותו, להציגו ולשתפו ככל הנדרש להפעלת התכונות הרלוונטיות (למשל הצגת שרשרת תהילים למשתתפות אחרות).

5. תרומות

• התרומות הן בהתנדבות. אלא אם נדרש בחוק, תרומות בדרך כלל אינן מוחזרות. אם לדעתך תרומה נעשתה בטעות, אנא פני אלינו.
• אנו לא שומרים את פרטי כרטיס האשראי המלאים שלך; אלה מטופלים ישירות על ידי Stripe.
• את אחראית לוודא את זכאות התרומה להטבת מס במקום מגורייך.

6. קניין רוחני

האפליקציה, לרבות עיצובה, הטקסטים, הגרפיקה, הלוגואים והתוכן המקורי שבה, היא בבעלות עזרת נשים או מעניקי הרישיון שלה ומוגנת בדיני קניין רוחני. תוכן תורני וחומרים אחרים עשויים להיות מסופקים על ידי תורמי תוכן ונשארים בבעלות בעליהם. אין להעתיק, לשכפל, להפיץ או ליצור יצירות נגזרות מהאפליקציה או מתוכנה ללא אישורנו מראש ובכתב, למעט לשימושך האישי והלא מסחרי.

7. שירותי צד שלישי

האפליקציה נשענת על שירותי צד שלישי, ובהם Supabase, Stripe, OneSignal ו-Hebcal. השימוש בתכונות אלה עשוי להיות כפוף לתנאים ולמדיניות הפרטיות של אותם ספקים. אנו לא אחראים לנהלים או לזמינות של שירותי צד שלישי.

8. תוכן דתי ומידע

התוכן באפליקציה, לרבות זמני תפילה, זמני שבת, הנחיות הלכתיות וחומרים תורניים, מסופק למטרות מידע והשראה בלבד. אנו שואפים לדיוק, אך זמנים ותוכן עשויים להשתנות לפי מיקום, שיטת חישוב ומנהג. יש להתייעץ עם סמכות רבנית מוסמכת בשאלות הלכתיות ולאמת מידע רגיש לזמן באופן עצמאי.

9. הסתייגויות

האפליקציה מסופקת "כמות שהיא" ו"ככל שהיא זמינה", ללא אחריות מכל סוג, מפורשת או משתמעת, לרבות אחריות לסחירות, להתאמה למטרה מסוימת ולאי הפרה. אנו לא מתחייבים שהאפליקציה תפעל ללא הפרעות, ללא שגיאות או באופן מאובטח, או שתוכן כלשהו יהיה מדויק או שלם.

10. הגבלת אחריות

במידה המרבית המותרת בחוק, עזרת נשים, מפעיליה, תורמי התוכן והשותפים שלה לא יהיו אחראים לנזקים עקיפים, מקריים, מיוחדים, תוצאתיים או עונשיים, או לאובדן נתונים, הנובעים מהשימוש שלך באפליקציה (או מחוסר היכולת להשתמש בה) או קשורים אליו.

11. סיום

אנו רשאים להשעות או לסיים את גישתך לאפליקציה בכל עת, עם או בלי הודעה, אם הפרת תנאים אלה או אם נפסיק את פעילות האפליקציה. באפשרותך להפסיק להשתמש באפליקציה ולמחוק את חשבונך בכל עת. הוראות שמטבען אמורות להישאר בתוקף לאחר הסיום ימשיכו לחול.

12. שינויים בתנאים אלה

אנו עשויים לעדכן תנאים אלה מעת לעת. על שינויים מהותיים נודיע דרך האפליקציה או בדרך אחרת. המשך השימוש באפליקציה לאחר כניסת השינויים לתוקף מהווה הסכמה לתנאים המעודכנים.
